TERMS AND CONDITIONS – INDEMNITY AND RELEASE FORMS
Please read this section carefully so there are no misunderstandings.
PRICES AND PAYMENTS
The prices for scheduled Island Biker tours are in United States Dollars (USD) and include the rental of a Harley Davidson motorcycle, light refreshments, lunch or light snack depending on the tour chosen, petrol, hotel/villa transfers, entrance fees and tour guides.
Prices for custom Island Biker tours are in United States Dollars (USD) and are subject to specific requirements and details of the custom tours.
All prices are subject to change without prior notice.
Prices DO NOT include personal insurance and medical evacuation, alcoholic beverages, additional food at scheduled stops, gratuities and any fines.
RESERVATIONS AND DEPOSITS
You can make your reservation by email, phone or through your hotel/villa tour desk. Your reservation is secured after we receive a 50% deposit. Payments must be made in cash (US dollars or Indonesian Rupiah). Bank exchange rates on the day of the reservation will apply. Personal cheques are not accepted. Full payments can be made on the day of the tour, prior to departure.
CANCELLATION AND REFUNDS
Once you have signed up for a tour and we have received your deposit, Island Biker will make advanced payments on certain items essential for a safe and successful tour which are unfortunately not recoverable. Because of this the following structure for refunds will be followed: - If cancellation is received more than 30 days prior to departure, a 70% refund will be made.
- If cancellation is received more than 21 days prior to departure, a 60% refund will be made.
- If cancellation is received more than 10 days prior to departure, a 50% refund will be made.
- If cancellation is received less than 10 days prior to departure, a 25% refund will be made.
No refunds will be given for no shows.
Island Biker reserves the right to cancel any tour for any reason. In such cases full refunds will be given.
PERSONAL INSURANCE
Island Biker does not provide personal health insurance covering injury to a rider or passenger. It is highly recommended that all participants (riders and passengers) take out additional insurance to cover accidents and injury, hospitalization and property loss.
MOTORCYCLES AND INSURANCE
All motorcycles used in Island Biker tours are well maintained Harley Davidsons and are rented for the purposes of touring. They come complete with insurance for the motorcycle. Riders will be expected to pay the first IDR 1,000,000 for any damage incurred while on a tour.
RIDER AND PASSENGER REQUIREMENTS
Riders must be at least 21 years of age and hold a current unrestricted motorcycle license for unlimited capacity motorcycles from their country of residence. In addition riders must have either an international driving license valid for motorcycles or a temporary local driving license.
All riders will be briefed about local riding rules and regulations of the road, which must be adhered to at all times. It is the rider’s responsibility to adhere to all traffic regulations while riding with Island Biker.
Passengers must be at least 12 years of age. Both riders and passengers must be aware of traffic, road conditions, weather and other motorcyclists.
Riders and passengers understand that motorcycling is a dangerous activity and they must be aware of the risks and fully accept those risks and be solely responsible for keeping their motorcycle under control, selecting proper speeds and adhering to the laws, rules and regulations of the Republic of Indonesia.
Riders are solely responsible for their choice of riding style and speed selection even when following a tour guide in a convoy with other motorcyclists.
Riders and passengers, their heirs, successors and assignors agree to release, indemnify and hold Island Biker, its agents, contractors, employees harmless from any and all liability claims directly or indirectly related to participating on a tour.
ISLAND BIKER’S RESPONSIBILITIES - ACKNOWLEDGEMENT
Island Biker is responsible for arranging and providing the services listed in the tour itineraries and descriptions. Island Biker is responsible for conscientious travel preparations. Island Biker reserves the right to change any part of a tour to improve its content or to adapt to changing conditions and situations that may arise. Island Biker is not responsible for any accidents and/or bodily injury or death resulting from the use of the motorcycle and riders and passengers. Island Biker is not responsible for any acts of God, strikes, thefts or other conditions beyond our control. Island Biker is not responsible for any personal property loss or damage while on a tour.
RIDER AND PASSENGER RESPONSIBILITIES – ACKNOWLEDGEMENT
Each rider and passenger must acknowledge reading, accepting and signing the Island Biker Terms and Conditions and Indemnity and Release Forms. By signing these forms, riders and passengers acknowledge and accept the risks of personal injury, property damage or any loss associated with motorcycling. Each rider and passenger rides at his or her own risk and is legally liable for injury or damage to fellow participants or other road users, whether being led by the tour leader or otherwise. Each rider must ride within his or her own skill level and with due consideration for their own safety and that of fellow travelers. Each rider and passenger must follow the instruction of the tour leader.
The tour leader reserves the right to cancel a rider’s or passenger’s tour if he considers the rider or passenger to be unsafe either to him or herself or to others, or for offensive behaviour and, therefore, forfeiting the balance of the tour.
REQUIRED DOCUMENTS
• Copy of valid unrestricted motorcycle license from country of residence.
• Copy of valid international driving license endorsed for motorcycles.
• Copy of passport.
• Original signed Terms and Conditions and Indemnity and Release Form.
JURISDICTION
This agreement between Island Biker and the participants shall be deemed to be made in the Republic of Indonesia and in the case of any disputes shall be decided in accordance with the laws of Indonesia. All parties agree that in the case of any disputes they will subject themselves to the laws and courts of Indonesia and agree to be bound by their decisions including all decrees and orders.
PHOTOGRAPHIC AND FILM RECORDS
Island Biker reserves the right to take photographs or film records of any tour and to use such photographs or film records for promotional, sales, brochures or other commercial purposes |
